01. 1. Heard Mr. Mishra, learned counsel for the petitioner.

2. Instant petition is filed under Section 5 of the Limitation Act by the petitioner for condonation of delay.

3. The revision is filed with the delay challenging thee impugned judgment as at Annexure-2 in Criminal Appeal No.30 of 2004 corresponding to S.T. Case No.45/95 of 2003 arising out of Dhusuri P.S. Case No.30 of 2003 for him having been convicted for an offence under Section 376 IPC.

4. A delay of 129 days is reported as per the SR. The Court is inclined to consider the response of the State.

5. Hence, it is ordered.

6. Notice.

7. Mr. Swain, learned AGA for the State accepts notice for the State. Objection, if any, shall be filed by the State before the next date.

8. List on 10th July, 2025.

2. Instant petition is filed seeking release of the petitioner on bail upon suspension of sentence in terms of Section 389 Cr.P.C. Since objection to the I.A. under Section 5 of the Limitation Act is directed to be filed by the State, this Court, as an interim measure, pending such response, directs that there shall be no coercive action taken against the petitioner till the next date.
