    01.        1.     This matter is taken up through Hybrid Arrangement
               (Virtual /Physical Mode).

2. Heard learned counsel for the petitioner as well as learned counsel for the State.

3. Learned counsel for the petitioner at the outset referring to the judgment of the Hon'ble supreme Court in Mahesh Damu Khare vs. State of Maharashtra and others reported in 2024(14) SCALE 480 contended before this Court that in an identical factual scenario the Hon'ble Apex Court has quashed the proceeding.

4. Extra copy of the application along with the judgment of the Hon'ble Supreme Court in Mahesh Damu Khare's Case (Supra) be served on learned counsel for the State. Learned

counsel for the State shall obtain instruction in the matter.

5. List this matter in the week commencing 4th August, 2025.

6. Heard.

7. Notice as above.

8. As an interim measure it is directed that on an application being filed by the petitioner learned trial court shall do well to adjourn the matter for a period of six weeks.
