02. 1. There shall be stay realization of fine amount as imposed in judgment dated 25th March, 2025 passed in S.T. Case No.145 of 2016 till disposal of the appeal.

2. The I.A. is disposed of.

03. 3. Heard Mr. H.B. Dash, learned counsel for the Appellant -

Petitioner and Mr. G. Tripathy, learned Additional P.P. for State - Respondent - Opposite Party.

4. The Appellant, namely Roshan Kumar Nayak, who has been convicted for commission of offences under Section 376(2)(n) / 417 of the Indian Penal Code and sentenced to undergo R.I. for ten years along with fine by the learned 1st Additional Sessions Judge, Rourkela in his judgment dated 25th March, 2025 passed in S.T. Case No.145 of 2016 has prayed to release him on bail pending appeal.

5. It is submitted that the Appellant was on bail during trial and now inside custody since 25th March, 2025 upon conviction.

6. Upon hearing Mr. Tripathy, learned Additional P.P. for State and after going through the evidences of P.W.1 and other witnesses, it is directed to release the Petitioner - Appellant on bail pending appeal on such terms and conditions to be fixed by the learned 1st Additional Sessions Judge, Rourkela in S.T. Case No.145 of 2016 including the condition that the Appellant shall furnish two sureties (with proper identity proof) out of which one shall be his relative.

7. The I.A. is disposed of.

04. 8. List the appeal for hearing in the 2nd week of November, 2025.

9. An urgent certified copy of this order shall be issued on proper application.
