01. 1. This matter is taken up through Hybrid mode.
2. Heard learned counsel for the Petitioner as well as learned counsel for the State. Perused the writ petition as well as documents annexed thereto.
3. The present writ petition has been filed by the Petitioner with the following prayers:
"It is therefore prayed that your Lordships may graciously be pleased to admit the Writ Application, issue Rule Nisi Calling upon the Opp. Parties to show cause as to why the writ application, would not be allowed and if they fail to show cause, or show false or insufficient cause may make the Rule absolute by giving' promotion
to Petitioner to the post of Senior Administrative Officer w.e.f. the date of retirement of the petitioner, as promotion to seven other employees of the same cadre have been given by virtue of the Order of the Hon'ble High Court of Orissa in
existing vacancies and 11 anticipated vacancies arising due to the retirement of the employees with all consequential benefits;
And may pass any other order / orders which your Lordships may deem fit and proper. And for which act of your kindness, the petitioners, as in duty bound ever pray."

It is stated by learned counsel for the Petitioner that although juniors to the Petitioner have been given promotion to the post of Senior Administrative Officer, however, the case of the Petitioner has not been considered. He further submitted that in the meantime the Petitioner has retired from service on attaining the age of superannuation w.e.f. 30.06.2023. Learned counsel for the Petitioner further referred to the judgment of a Coordinate Bench of this Court in Pramath Kumar Mallick v. State of Odisha & Anr. in W.P.(C) No.31396 of 2024 along with a batch of other similar writ petitions which were disposed of vide a common judgment dated 28.03.2025 in support of his contention.
5. Learned counsel for the State on the other hand submitted that the Petitioner has not approached the departmental authorities before approaching this Court. In such view of the matter, learned counsel for the State contended that the present writ petition is not maintainable as the Petitioner has not approached the departmental authorities for redressal of his grievance.

In view of the aforesaid limited nature of grievance of the Petitioner, this Court disposes of the writ petition granting liberty to the Petitioner to file a fresh representation before the Opposite Party No.1 ventilating his grievance within a period of three weeks. If such a representation is filed within the time stipulated, the same shall be considered and disposed of by the Opposite Party No.1 within a period of eight weeks from the date of filing representation by passing a speaking and reasoned order. The decision so taken on the same shall be communicated to the Petitioner within a period of ten days from the date of taking such a decision.
7. With the aforesaid observations/directions, the writ petition is disposed of.
