Mr. Mishra, learned counsel for the appellants has submitted the Death Certificates of the appellant no.1- Sakuntala Pani and appellant no.3- Shuvendu Kumar Pani dated 16.09.2011 issued by the Registrar, Births & Deaths, Bhubaneswar Municipal Corporation, Government of Orissa, Department of Health and Family Welfare, Bhubaneswar. As per the said Death Certificates, the appellant no.1- Sakuntala Pani died on 12.04.2012 and appellant no.3-

Shuvendu Kumar Pani died on 23.08.2011. Therefore, the appeal vis-à-vis appellant no.1- Sakuntala Pani and appellant no.3- Shuvendu Kumar Pani stands

abated. The said Death Certificates are taken on record.

2. In so far as the appellant no.2 is concerned, she is alive. The appeal is ready for hearing.

3. Heard Mr. Mishra, learned counsel for the appellant and Mrs. Sarita Maharana, learned Additional Standing Counsel appearing on behalf of the Respondent-State.

4. Hearing is concluded and judgment is reserved.
