2. 1. Heard Mr.Dash, learned counsel for the Appellant and Mr.Mishra, learned Additional Public Prosecutor for the State.

2. None appears on call for the Informant/victim despite service of notice is made sufficient on her as per the office note and postal tracking report.

3. The Appellant, who has been convicted for commission of offence under section 6(1) of the POCSO Act read with Sections 376(2)(n), 363, 342 and 506 of the IPC by the learned Addl. District and Sessions Judge-cum-Special Court under POCSO Act, Phulbani in C.T.Case No.12/2023 corresponding to Gochhapada P.S.Case No.26 of 2023 and sentenced to undergo R.I. for a period of twenty years along with fine in judgment dated 23.9.2024, has prayed to release him on bail pending appeal.

4. It is submitted on behalf of the Appellant that though the victim is a major girl, but the learned trial court did not accept the same.

5. Upon hearing both parties and considering the evidence of the victim (P.W.1) and the materials produced including her educational certificate regarding her age vis-à-vis the age of the Appellant, I am not inclined to release the Appellant on bail at this stage.

6. Accordingly, the prayer for bail is rejected.

7. The I.A. is disposed of.

8. List the appeal in the last week of November 2025 for hearing.
