01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties. Perused the writ petition as well as the documents annexed thereto.
3. The present writ petition has been filed by the Petitioner with the following prayers:-
"The petitioner therefore, most humbly prays that, your lordship would be graciously pleased to issue rule nisi calling upon the Opp. Parties to show cause as to why impugned transfer order dated 28/01/2025 at Sl. No.1 in respect of the petitioner at Annexure-2 and relieve order dated 31/01/2025 at Annexure-4 should not be quashed by holding that the same is not permissible under law.
And further be pleased to direct the Opp. Parties to allow the petitioner to continue in his previous place of posting i.e., in Regional Office, State Pollution Control Board, Kalinga Nagar, Jajpur with continuity of service from the date of his relieve till his resuming his duty at Regional Office, State Pollution Control Board, Kalinga Nagar, Jajour with all consequential service benefit.
And further this Hon'ble Court may graciously be pleased to pass any other order(s)/direction(s) as would be deemed fit and proper in the circumstances of the case."
4. It is submitted by the learned counsel for the Petitioner that the Petitioner wants to make a fresh representation before the authority concerned with a direction from this Court to the authority to consider the case of the Petitioner within a stipulated period of time.
5. Learned counsel for the State-Opposite Parties submits that he has no objection if the Petitioner is permitted to file a fresh representation before the authority concerned with a direction to the authority concerned to consider the representation of the Petitioner in accordance with law within a stipulated period of time.
6. Considering such submission and without expressing any opinion on the merit of the case, this Court disposes of the writ petition permitting the Petitioner to make a fresh representation before the Opposite Party No.1 within a period of ten days from today and in such event the representation filed by the Petitioner
taking therein all the grounds along with all relevant documents and a copy of the judgment relied upon, the Opposite Party No.1 shall do well to consider and dispose of the same by passing a speaking and reasoned order within a period of four weeks from the date of filing of such representation. The decision so taken on such representation shall be communicated to the Petitioner within two weeks thereafter. Further, it is directed that the order under Annexure-2 to the writ petition shall not be given effect to for a period of six weeks or till disposal of the representation of the Petitioner by the Opposite Party No.1
