01. 1. Heard Mr. Rath, learned Senior Advocate appearing for the petitioners.

2. Instant petition is filed by the petitioners challenging the correctness of the impugned judgment in 19th November, 2024 passed in FAO No.164/47 of 2023 by learned 1st Additional District Judge, Puri under Annexure-1 modifying the order in I.A. No.61 of 2022 of learned Senior Civil Judge, Pipili in C.S. No.101 of 2022 vide Annexure-7 on the grounds stated therein.

3. Considering the facts pleaded on record and submissions of Mr. Rath, learned Senior Advocate appearing for the petitioners, the Court is inclined to issue notice to the opposite parties.

4. Accordingly, it is ordered.

5. Issue notice to the opposite parties through Special Messenger and the cost is to be deposited by 6th February, 2025.

6. List this matter on 11th February, 2025 for hearing orders.
