01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in connection with C.T. Case No.333 of 2021 pending in the Court of learned S.D.J.M, Boudh, arising out of Boudh P.S. Case No.0080 of 2019 for commission of offence punishable under Sections 379/34 of IPC.
3. Taking into account that the co-accused has been acquitted by judgment dated 26.10.2018 passed by the learned Sub-Divisional Judicial Magistrate, Boudh in T.R No.33 of 2021 arising out of Boudh P.S. Case No.80 dated 29.03.2019, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner shall be released on
bail by the learned Court in seisin on such terms as deemed just and proper.
4. It is needless to state that the Petitioner shall cooperate with the ongoing investigation.
5. Accordingly, the ABLAPL stands disposed of.
6. Urgent certified copy of this order be granted as per rules.
