Order No.                               03.02.2025
  01.       1.        Mr. Rout, learned advocate appears on behalf of

appellant and submits, appeal has been preferred against judgment

dated 16th July, 2024 of the learned single Judge. His client's one

writ petition was allowed and the other, rejected.

2. There were two disciplinary proceeding initiated against

his client. In the first there was award of one black mark and in the

second, two. The first writ petition was allowed. The second writ

petition regarding award of two black marks in the disciplinary

proceeding met with rejection. The learned single Judge failed to

appreciate the facts.

3. The allegation against his client was refusal or omission

to register FIR mentioning section 376 in Indian Penal Code, 1860.

Drawing attention to the complaints reflected at pages 85 onwards

in the appeal brief he submits, the allegations did not constitute

offence of rape. He seeks interference in appeal.

4. Mr. Panda, learned advocate, Additional Government

Advocate appears on behalf of State. He has adjournment to

demonstrate, allegation amounting to rape appears in the case

information documents disclosed in the appeal brief.
