03. This matter is taken up through hybrid mode.

2. Heard learned Counsel for the parties.

3. During hearing, learned Counsel for the Opposite Party files photocopies of the judgments reported in (2013) 14 SCC 1 (M/s. Bagai Construction Thr. Its Proprietor Lalit Bagai Vs. M/s. Gupta Building Material Store), (2011) 11 SCC 275 (K.K. Velusamy Vs. N. Palanisamy) in the Court to substantiate his submission, which are taken on record.

4. The matter be listed in the week commencing from 2nd February, 2026 for further hearing.

5. As an interim measure, further liberty is granted to the Petitioner to move for an adjournment before the learned Court below in C.P. No.611 of 2019.

6. It is made clear that, if such an application is moved, the learned Court below shall do well to adjourn the case to any date beyond the week commencing from 2nd February, 2026.

7. The parties are given liberty to utilize the digitally signed copy of this order, available in the website of this Court, for the purpose of communication to the learned Court below.
