05. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
This is an application for interim bail on the ground of ailment of the mother of the appellant. The medical documents have been annexed to the interim application.
Heard learned counsel for the appellant and the learned counsel for the State.
The appellant-petitioner has been convicted under sections 302/201 of the Indian Penal Code and was sentenced to undergo rigorous imprisonment for life and to pay a fine of Rs.5,000/- (rupees five thousand) in default, to
undergo R.I. for one month for the offence under section 302 of the Indian Penal Code, however no separate sentence was imposed for commission of offence under section 201 of the Indian Penal Code, as directed by the learned Sessions Judge, Keonjhar in S.T. Case No. 17 of 2022 arising out of G.R. Case No. 1752 of 2021.
Perused the impugned judgment.
Learned counsel for the has produced the written instruction dated 16.12.2025 of the IIC, Pandapada P.S., which shows that the mother of the appellant is suffering from old CVA due to left side hemiparesis and undergoing treatment and there is no one with her for taking of herself and she is staying alone in her house. She has also produced the custody certificate, conduct and criminal antecedent of the appellant. The report relating to criminal antecedent shows that there is criminal antecedent against the appellant. The reports are taken on record.
Considering the submissions made by learned counsels for the respective parties, the averments made in the interim application along with the medical documents and the instructions received by the learned counsel for the State, we are inclined to release the appellant-petitioner on interim bail for a period of thirty days from the date of his release. The appellant-petitioner shall surrender before the learned trial Court on expiry of thirty days period.
For the above period, let the appellant-petitioner be released on interim bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(rupees twenty thousand) with one
local solvent surety for the like amount to the satisfaction of the learned trial Court, subject to condition that while on interim bail the appellant-petitioner shall not indulge in any criminal activities in any manner.
Violation of any of the conditions shall entail cancellation of interim bail.
The I.A. is disposed of accordingly. Issue urgent certified copy of this order as per rules.

Learned counsel for appellant shall file the surrender certificate of appellant-petitioner on the next date.
