09. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This is an application for interim bail filed by the appellant on the ground that the father of the appellant expired on 01.12.2025 and to perform the obsequie ceremony, the presence of the appellant is very much necessary.

Heard learned counsel for the appellant and the learned counsel for the State.

The appellant has been convicted under sections 376- D/458/394/506(II) of the Indian Penal Code and was sentenced to undergo rigorous imprisonment for life and to pay a fine of Rs.10,000/- (rupees ten thousand), in default,

to undergo R.I. for one year for the offence under section 376-D of the Indian Penal Code, sentenced to undergo R.I. for seven years and to pay a fine of Rs.3,000/- (rupees three thousand) in default, to undergo R.I. for six months for the offence under section 458 of the Indian Penal Code; further sentenced to undergo R.I. for seven years and to pay a fine of Rs.3,000/- (rupees three thousand) in default, to undergo R.I. for six months for the offence under section 394 of the Indian Penal Code and R.I. for two years and to pay a fine of Rs.2,000/- (rupees two thousand), in default to further undergo R.I. for six months for the offence under section 506(II) of the Indian Penal Code and all the substantive sentences are run concurrently, as directed by the learned Sessions Judge, Cuttack in S.T. Case No. 44 of 2017 arising out of G.R. Case No. 1265 of 2016.

Perused the impugned judgment.

Learned counsel for the State has produced the report dated 12.12.2025 received from the IIC, Dhamnagar, Police Station, Bhadrak, which shows about the death of the father of the appellant on 01.12.2025. The report furnished by the learned counsel for the State is taken on record.

Considering the submissions made by the learned counsel for the respective parties, the averments taken in the interim application and the report produced by the learned counsel for the State, we are inclined to release the appellant-petitioner on interim bail for a period of two weeks from the date of his release. The appellant shall surrender before the learned trial Court on expiry of two weeks period.

For the above period, let the appellant-petitioner- Sanjay Das be released on interim bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(rupees twenty thousand) with one local solvent surety for the like amount to the satisfaction of the learned trial Court, subject to condition that while on interim bail the appellant shall not indulge in any criminal activities in any manner and shall not come in contact with the victim or any of her family members.

Violation of any of the conditions shall entail cancellation of interim bail.

The I.A. is disposed of accordingly. Issue urgent certified copy of this order as per rules in course of the day.

10. Put up this matter in the week commencing from 5th January, 2026.
