06. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
These applications have been filed by the appellant for bail.
Heard learned counsel for the appellant and the learned counsel for the State.
The appellant-petitioner has been convicted under sections 302/394/454 of the Indian Penal Code and was
sentenced to undergo rigorous imprisonment for life and to pay a fine of Rs.5,000/- (rupees five thousand) in default, to undergo R.I. for one month for the offence under sections 302 of the Indian Penal Code. Further the appellant was sentenced to undergo R.I. for three years and to pay a fine of Rs.2,000/- (rupees two thousand) in default, to undergo R.I. for one month more on each count under sections 394/454 of the Indian Penal Code and all the sentences shall run concurrently, as directed by the learned Sessions Judge, Khurda at Bhubaneswar in Criminal Trial No. 42 of 2014 arising out of C.T. No. 3536 of 2013.
Perused the impugned judgment.
Mr. Mishra, learned Senior Advocate for the appellant submits that the appellant is in judicial custody for more than twelve years and he is suffering from cancer. He further submits that the case is based on circumstantial evidence.
Vide order dated 19.09.2025, we asked the learned counsel for the State to obtain instruction on the interim application and today learned counsel for the State has produced the health condition report along with the medical reports, which shows that the appellant is suffering from cancer. He has also produced the custody certificate of the appellant, which shows that the appellant is in judicial custody for more than twelve years. The reports are taken on record.
Considering the submissions made by learned counsels for the respective parties, the period of detention of the appellant in the judicial custody, taking into account the health condition report of the appellant and absence of any chance of early hearing of the appeal in the near future, we are inclined to release the appellant-petitioner on bail.
Let the appellant-petitioner-Dipti Ranjan Pattnaik @ Nayak be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000/-(rupees twenty thousand) with one local solvent surety for the like amount to the satisfaction of the learned trial Court, subject to the condition that while on bail the appellant- petitioner shall not indulge in any criminal activities in any manner.
Violation of any of the conditions shall entail cancellation of the bail.
The I.As. are disposed of accordingly. Issue urgent certified copy of this order as per rules.
