10. 1. Heard learned Counsel for the Appellant.

2. Admit.

3. Since, Mr. A.K. Dash, learned Counsel has already appeared representing all the private Respondents and admits to have received copy of the Appeal Memo, no notice of hearing need be issued to the Respondents.

4. Office is directed to call for the scanned copy of the LCR before the next date of listing.

5. The matter be listed in the week commencing from 13th October, 2025 under the heading "For Hearing".

11. 1. In view of the admission of the Appeal, operation of the impugned Judgment so also further proceeding in Execution Case No.1 of 2025, arising out of TC No.10 of 2007, pending in the Court of learned PTTCBA(O)-Cum-Additional District Judge, Talcher are stayed subject to depositing 50% of the principal amount within three weeks hence. If such an amount is deposited, the learned Court below shall do well to keep the said amount in form of a fixed deposit in any of the nationalized banks.

2. Accordingly, both the I.As. stand disposed of.

3. Urgent certified copy of this order be granted on proper application as per rules.
