2. Heard Mr. S.S. Tripathy, learned counsel for the appellant. Perused the impugned judgments.

3. Considering the submissions and the grounds raised, the second appeal is admitted on the following substantial questions of law:-

i. Whether the trial court was wrong in framing issues, which were not in conformity with the pleadings of the parties, particularly Issue Nos. VI, VII and VIII?

ii. Whether both the courts below were correct in holding that the relief claimed for declaration regarding the cancellation deed dated 06.05.1998 and the validity of RSD dated 18.10.2021 is not barred by limitation?

4. Issue notice to the respondents by registered post with A.D. making it returnable within four weeks. Requisites be filed within three working days.

5. Call for the LCR.

6. List this matter in the month of April, 2026 for hearing.
