ORDER
07.08.2025 Order No.
03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel for the parties.
3. Petitioner has filed the present Writ Petition inter alia with the following prayer:-
"Under the above circumstances, the petitioner therefore, most humbly prays that your lordships would be graciously pleased to issue a Rule NISI calling upon the Opp. Parties to show cause as to why the impugned orders dated 31.10.2023 at Annexure-5, 07.12.2023 at Annexure-6, and order dated 12.03.2024 at Annexure-7 reducing the grade pay of the petitioner from Rs.4200 to Rs.2800 and directing for recovery to the tune of Rs.6,59,021/- in 48 monthly installments starting from the month of April, 2024 should not be quashed and as to why the Opp. Parties should not be directed to allow the petitioner Grade Pay of Rs.4800/- by declaring that, the order dated 06.03.2014 at Annexure-4 is legal and valid in law.
// 2 //
And issue any other order/direction which would afford complete relief to the petitioner in the facts and circumstances of the case."
4. It is contended that the issue involved in the present case is squarely covered by an order passed by this Court on 02.01.2025 in W.P.(C) No.28862 of 2023. It is also contended that the order passed in the said Writ Petition has already been duly implemented vide office order dated 28.05.2025. (Copy of order dated 28.05.2025 so produced in Court by way of a memo be kept in record).
5. Even though learned Addl. Govt. Advocate contended that the issue is not similar, but this Court after going through the materials available on record and the order passed in W.P.(C) No.28862 of 2023, is of the view that the issue is completely similar. Therefore, this Court is inclined to dispose of the Writ Petition in the light of the judgment passed on 02.01.2025 in W.P.(C) No.28862 of 2023.
6. The Writ Petition stands disposed of.
