  01.       1.       Heard learned counsel for the Petitioners and the
            State.

2. Instant writ petition is filed by the petitioners for a direction to the opposite parties to declare Section 22 of the OLR Act not to be applicable in respect of the Gharabari land belongs to Schedule Caste and Schedule Tribe with consequential relief.

3. In course of hearing, Mr. Nayak, learned counsel for the Petitioners submits that the case of the Petitioners are covered by the judgment in Hemanta Naik and others -Vrs.- State of Odisha, 2024 (II) OLR 588. The copies of the Court's order in W.P.(C) Nos.20693 and 22872 of 2024 are produced in Court today by Mr. Nayak, learned counsel for the petitioners and further submits that similar relief may be extended to the petitioners.

4. Recorded the submission of Mr. Dash, learned AGA for the State.

5. In view of the submission made by Mr. Nayak, learned counsel for the petitioners with the plea that the case of the petitioners stand covered by the judgment in Hemanta Naik (supra), the Writ Petition stands disposed of with the matter to be considered by the appropriate authority according to law examining the fact that the Petitioners stand in the same footing.

6. Urgent certified copy of this order be issued as per rules.
