04. This matter is taken up through hybrid mode.

2. Learned Counsel for the parties are absent on call.

3. This transfer petition has been filed for transfer of MAC No.179 of 2014, pending in the Court of District Judge-cum-MACT, Jajpur to Court of 1st MACT, Cuttack.

4. In view of the judgment of this Court reported in 2024 Live Law (Orissa) 72 (Gulsan Bibi & ors. Vs. Swapan Kumar Ghos & ors.), this Court is of the view that the present transfer petition filed under section-24 of the Code of Civil Procedure is not maintainable.

5. Accordingly, the transfer petition stands dismissed as to not maintainable.

6. Interim order dated 05.09.2019 passed in I.A. No.248 of 2019 stands vacated.

7. It is made clear that the Petitioner will be at liberty to approach the appropriate forum for redressal of his grievances, if any cause of action still survives.

8. Office is directed to communicate a copy of this order to the court below.
