2. 1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is apprehending arrest in connection with Jeypore Sadar P.S. Case No.211/2020 corresponding to T.R. Case No.79/2020 pending in the court of learned Sessions Judge-cum- Special Judge, Koraput at Jeypore, for the alleged commission of the offence under Sections 20(b)(ii)(c) of the N.D.P.S. Act read with Sections 25 and 27 of the Arms Act.

4. The prosecution case is that seven persons were involved in transportation of contraband ganja. Out of them four persons faced trial in the Court of learned Addl. Sessions Judge-cum-Special Judge, Jeypore in T.R. Case No.79/2020 and have been acquitted by judgment passed on 17th April, 2020. In so far as the present

Petitioner is concerned, he is implicated on the statement of the co- accused.

Having regard to the fact the principal accused persons have in the meantime been acquitted while not being inclined to grant anticipatory bail to the Petitioner, the ABLAPL is disposed of granting liberty to the Petitioner to surrender before the Court below within a week from the date of receipt of certified copy of this order and to move for bail. In such event, he shall be released on bail on such terms and conditions as may be deemed fit and proper by the said Court.

6. Urgent certified copy of this order be granted on proper application.
