This matter is taken up through Hybrid mode.

2. This application has been filed by the applicants/appellants seeking condonation of delay of 96 days in filing the present writ appeal.

3. Ms. P.P. Rao, learned counsel appearing on behalf of the respondent submits that sufficient cause has not been shown in this application for condoning the aforesaid delay.

4. After hearing learned counsel, perusing the application and in the interest of justice, we are satisfied that this is a fit case for condoning the delay in filing the writ appeal, but subject to payment of cost of Rs. 2000/- to the respondent within a period of two weeks.

5. Hence, the delay of 96 days in preferring the present writ appeal stands condoned.

6. The I.A. is accordingly allowed and disposed of.

7. Mr. Bimbisar Dash, learned Additional Government Advocate undertakes to serve a copy of the appeal memo on Ms. Rao, learned counsel appearing on behalf of the respondent by tomorrow.

8. List this matter on 09.12.2024 for fresh admission.

9. It is stated at the Bar that order of the learned Single Judge, which has been relied upon in this case has been challenged in W.A. No.557 of 2022, which has been heard and reserved for judgment by this Court.

10. Accordingly, list this matter on 16.12.2024.
