02. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard Ms. Soumya Jyoti Biswal, learned counsel for the petitioner.

While trying to explain the delay in approaching this Court by filing this writ petition, in paragraph No.6 of the writ petition, the averments have been taken that the petitioner was always kept in the dark and was never informed regarding any action taken by the opposite party nos.1 and 2. She urged that when the opposite party-Bank filed a writ petition bearing W.P.(C) No.15886 of 2019 before this Court with similar prayers, the petitioner never received any notice in the said case and it was

only brought to the knowledge of the petitioner when he wrote a letter demanding for answers and the opposite party no.2 replied to the said letter wherein the petitioner came to know about the existence of the said case.

Learned counsel for the petitioner submitted that the said writ petition has already been disposed of and the matter may be taken up tomorrow to enable him to file the copy of the order.

Learned counsel for the petitioner filed the memo of citations containing the judgment of the Hon'ble Supreme Court in the case of PHR Invent Education Society -Vrs.- UCO Bank and others reported in (2024) 6 Supreme Court Cases 579 and order of this Court in the case of Ratnakar Senapati -Vrs.- Debt Recovery Tribunal, Cuttack & Ors. [dated 30.10.2024 passed in W.P.(C) No.25532 of 2024], which are taken on record.

List this matter tomorrow, i.e. 21.11.2024.
