01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This revision petition is directed against the impugned judgment dated 22.03.2024 passed in CRP No. 72 of 2023 by which the learned Judge Family Court, Nabarangpur has refused to set aside the ex- parte order dated 09.08.2021 and ex-parte judgment dated 14.09.2021 passed in CRP No. 30 of 2021 in an application U/S. 126(2) of the CrPC.
3. Heard Mr.R.L.Pattnaik, learned counsel for the petitioner and perused the impugned judgment, but this Court does not find any error apparent in the said judgment to interfere inasmuch as the learned trial Court has recorded a finding that no reason has been assigned for the absence of the petitioner on the date concerned and there is nothing to show that the petitioner has suffered from the disease of
COVID-19. However, the petitioner could not produce a single scrap of paper to dispute the aforesaid finding of the learned Judge Family Court, Nabarangpur. Consequently, no ground is made out to interfere in the impugned order in this revision.
In the result, the RPFAM stands dismissed, but in the circumstance without any costs.
