03. 1. This matter is taken up through hybrid arrangement.

2. Heard.

3. In this Writ Petition, the Petitioner has challenged the order

dated 24.11.2023 passed in Revision Petition No.2668 of 2023

by the learned National Consumer Disputes Redressal

Commission, New Delhi arising out of the order dated

23.05.2019 passed in First Appeal No.A/53 of 2019 by the State

Consumer Disputes Redressal Commission, Orissa Cuttack

wherein confirming the order dated 16.07.2018 passed by the

learned District Consumer Disputes Redressal Forum, Khurda

at Bhubaneswar.

4. Learned counsel for the Petitioner has satisfied the

maintainability of the Writ Petition by referring the judgment

of the Hon'ble Supreme Court in M/s. Universal Sompo

General Insurance Co. Ltd. vs. Suresh Chand Jain & Anr.

decided on 26th July, 2023 in Special Leave Petition (Civil)

No.5263 of 2023.

5. Issue notice to the Opposite Parties through Registered Post

with A.D./Speed Post making it returnable by 20th February,

2024. Requisites shall be filed within five working days hence.

6. List this matter on 21st February, 2024.
