02. 1. Mr. Nayak, learned advocate appears on behalf of
applicant/appellant-husband. He submits, his client is aggrieved by
judgment dated 19th June, 2023 of the family Court to extent that
permanent alimony directed is exorbitant.
2. He submits further, there was no delay in filing the appeal but
certified copy of impugned judgment was filed later, on 11th December,
2023. As such, the delay be condoned.

3. Reported delay is 78 days considering valid presentation on 11th
December, 2023, date the certified copy was filed. Mr.Nayak submits,
respondent-wife also filed appeal (MATA no.276 of 2023), due to be
listed on 8th January, 2024.
