02. 1. This matter is taken up through hybrid arrangement.

2. Through this Criminal Revision the Petitioner has not

only challenged the judgment/order dated 10.04.2023

passed by the learned Sessions Judge, Balangir in

Criminal Appeal No.08/2022, but has also challenged the

judgment of conviction and order of sentence dated

19.08.2022 passed by the learned Sub-Divisional Judicial

Magistrate, Balangir in 1.C.C. No.13 of 2014

3. Heard.

4. Admit.

5. Learned counsel for the State waives of notice on behalf

of the Opposite Party No.1. One extra copy of the

CRLREV be served on learned counsel for the State to

take instructions in the matter. Further, let notice be

issued to the Opposite Party No.2 by Regd. Post with

A.D./Speed Post making it returnable by 6th March, 2024.

Requisites shall be filed within three working days from

today.

6. List this matter on 7th March, 2024.

7. Heard.

8. Learned counsel for the petitioner submits that the

petitioner was all along on bail during the trial as also

during the appeal in the court below.

9. In view of such submission made by the learned

counsel for the Petitioner, this Court directs that the

Petitioner shall surrender before the learned court in

seisin over the matter in connection with I.C.C Case

No.13 of 2014 and deposit a sum of Rs.1,00,000/- (Rupees

One lakh) within One month hence and apply for bail. In

such event, the Petitioner shall be released on bail in the

aforesaid case on such terms and conditions as deemed

just and proper by the learned court in seisin over the

matter.

10. The I.A. is disposed of, accordingly.

12. Realization of fine amount shall remain stayed till

disposal of the revision.

13. The I.A. is disposed of.
