1. This appeal has been filed challenging the judgment dated 03.08.2023 passed by the learned Judge, Family Court, Jajpur in Civil Proceeding No. 77 of 2019 dismissing the application filed by the appellant under Section 12 read with Section 5(ii) of the Hindu Marriage Act, 1955 praying for a declaration that the marriage solemnized between the parties was voidable.
2. Mr. B.P. Mohanty, learned counsel for the appellant submits that in a separate proceeding under Section 125 of Cr.P.C., the respondent has been awarded monthly maintenance of Rs.7,000/- per month. Although the appellant has challenged the said order, he is paying Rs.7,000/- per month to the respondent towards monthly maintenance.
3. Issue notice on the question of admission to the sole respondent by Registered Post with A.D returnable within four weeks, requisites for which shall be filed by 25.09.2023.
4. List this matter on 16.11.2023.
