51. 1. Mr. Chittaranjan Mohanty, the Petitioner in person has stated that

he has not received the additional affidavit filed by the Opposite

Party Nos.1 and 2 on 7th July, 2023 in W.P.(C) No.16602 of 2016.

2. Mr. Debakanta Mohanty, learned Additional Government

Advocate for the State-Opposite Party Nos.1 and 2 has supplied a

copy of the said affidavit to Mr. Chittaranjan Mohanty in Court

today.

3. At this juncture, Mr. Chittaranjan Mohanty, the Petitioner prays

for a short accommodation for filing a response to the said affidavit,

if required.

4. Let these matters be listed on 26th September, 2023. The

response, if any, shall be filed by 25th September, 2023.

5. The Petitioner has also referred to the judgment of the apex court

in Paschim Banga Khet Mazdoor Samity and others v. State of

West Bengal and another; AIR 1996 SC 2426. A copy of the said

judgment supplied by the Petitioner is taken on record.

6. It has been reported that Mr. Debasis Nayak, learned counsel

appearing for the Cuttack Municipal Corporation (CMC) is unwell

and he is not attending the Court.
