1. This application under Section 482 of Cr.P.C. has been filed by the petitioner challenging the order dated 28.01.2017 passed by the learned S.D.J.M., Nayagarh in G.R. Case No.307 (A) of 2016 arising out of Nuagaon P.S. Case No.45 of 2016 under Section 394 of IPC read with Section 25 and 27 of the Arms Act.

2. Mr. Manas Chand, learned counsel for the petitioner submits that the petitioner has been implicated in this case only on the basis of the statement of co-accused, Bibhukalayan Rout who has been acquitted after facing trial alongwith Dhaneswar Pradhan and Bichitrananda Baliarsingh vide judgment dated 02.01.2018 passed in G.R. Case No.307 of 2016/T.R.No.543 of 2017.

3. Mr. Chand, learned counsel prays for an adjournment to make further submissions. List this matter on 30.10.2023.
