   25.      1.      This matter is taken up through hybrid arrangement
            (virtual/physical) mode.

2. This is an Appeal of the year 1989. In the meantime more than 30 years have already been passed. It appears from the noting of the Registry that, though photocopy of the LCR was received, but the exhibited documents have not yet been received from the lower Court. According to the submission of learned counsel for the Appellants that, the perusal of the exhibited documents are necessary for the just decision of the Second Appeal.

3. This second Appeal has arisen from the judgment and decree passed in T.S. No.24 of 81 by the learned Sub-ordinate Judge, Patnagarh in the District of Balangir. Therefore, the District Judge, Balangir is directed to send the exhibited documents of T.S. No.24 of 1981 (which was disposed of by the learned Sub-ordinate Judge, Patnagarh and the first Appeal thereof vide Title Appeal No.22/16 of 82-85 was disposed of by the learned Additional District Judge, Balangir).

4. List this matter on 11.12.2023 for hearing. The copy of this order be sent to the District Judge, Balangir for its proper compliance i.e. for submission of exhibited documents in T.S. No.24 of 1981.
