1. 1. Mr. Mishra, learned advocate appears on behalf of appellant-

husband. He submits, impugned is judgment dated 27th June, 2023, whereby the family Court decreed the civil proceeding filed by respondent-wife for restitution of conjugal rights. Said Court committed gross error as it noticed that his client had already filed for divorce. The appeal has been filed in time.

2. Appellant will put in requisites for issuance of notice of appeal.
