19. 1. Mr. Mohanty, learned advocate appears on behalf of
appellants (wife and daughter). He submits, his client is
aggrieved by judgment dated 28th September 2018 of the
Family Court to extent of quantum of permanent alimony
granted thereby. It is meager sum of Rs.5 lakhs, where
respondent-husband deals in real estate and his client is
unemployed.
2. He submits, judgment of the Supreme Court in Rajnesh
v. Neha, reported in (2021) 2 SCC 324, paragraph 129 is
clearly applicable for purpose of adjudication of the appeal.
There be direction for compliance by filing affidavits of
income, assets and liabilities.
3. Mr. Dash, learned advocate appears on behalf of
respondent-husband and prays for adjournment to make
submission on application of Rajnesh v. Neha (supra)
considering that the civil proceeding was filed and impugned
judgment made, prior to date of the decision.
