3. Mr. R. N. Mishra, learned Additional Government Advocate appearing for the State-Appellants contended that the matter is covered by the judgment of this Court in the case of State of Odisha and another v. Joseph Barik (W.A. No. 805 of 2021 and batch, disposed of on 11.05.2023). But, this appeal has been filed with delay of 204 days.

4. Issue notice to the Respondent on the question of limitation by registered post with A.D., for which requisites shall be filed within three working days. Office shall send notice to the said Respondent fixing an early returnable date.
