15.11.2023 I.A. no.347 of 2023 and I.A. no.348 of 2023 Order No.
01. 1. Mr. Dash, learned advocate appears on behalf of
applicant/appellant-wife. He submits, his client is aggrieved by
judgment dated 11th April, 2023 made by the family Court dissolving
the marriage and directing permanent alimony. His client was unaware
of impugned judgment. Discovery was on instrument for permanent
alimony sent by post. His client has not accepted it. By reason of
ignorance of the proceeding and impugned judgment and subsequent
discovery, the appeal was filed on delay. Application for condonation
// 2 //
has been made. He submits, the delay be condoned and the appeal
admitted. Reported delay is 78 days. His client has made another
application for stay of operation of impugned judgment since
respondent-husband is likely to get remarried.
2. Issue notice along with this order upon respondent-husband on
the application for delay, stay and appeal. Accept one set of process
fee for service by registered/speed post with AD. Applicant will put in
requisites.
3. List on 6th December, 2023. Impugned judgment will remain
stayed till next date of hearing.
