MATA No.240 of 2023 and I.A. no.252 of 2023 Order No.

01. 1. Mr. Sahu, learned advocate appears on behalf of appellant-

husband. He submits, his client is aggrieved by judgment dated 27th April,

2023 made by the family Court to extent that there was direction for

payment of permanent alimony. The appeal has been filed in time.

2. Appellant will put in requisites for issuance of notice of appeal.

3. Lower Court record be called for.

4. On query from Court Mr. Sahu submits, there was no direction to

pay interim maintenance. On further query from Court regarding

direction for payment of permanent alimony being akin to a money

decree he submits, his client will put in security of ₹2,00,000/-.

5. There will be unconditional stay of Execution Case no.6 of 2003

pending in family Court, Sonepur, till 20th November, 2023. Appellant

must put in cash security of ₹2,00,000/- with Registrar (Judicial) on or

before that date. On the deposit made, the Registrar will invest it in a

short term interest bearing account with any nationalized bank. In event

the deposit is made the stay will continue till disposal of the appeal.

Otherwise, it will stand automatically vacated.
