3. The present writ petition has been filed with the following prayer:

"It is therefore prayed that this Hon'ble Court may graciously be pleased to admit the writ petition and issue notice to the opposite parties and call for records and upon hearing them to pass for an appropriate direction to the opposite parties more especially opposite party No-2 to 4 i.e., tender inviting authorities to consider technical bid evaluation of the petitioner more especially on the "Information Submitted by the petitioner in Schedule F (in Affidavit Shape) in respect of work "Improvement to Kalampur-Pandigoan-Chhack to Mukhiguda Road From 10/000 km to 23/618 km in the District of Kalahandi under State Plan" in view of the settled principles of law as laid down in case of Sri Kaustav Sahu Vs. State of Odisha reported in 2017(II) OLR 342 to secure ends of justice"

In course of hearing, learned counsel for the petitioner states that the petitioner may be permitted to file a fresh representation before the opposite party no.3 highlighting the grievances and the same may be directed to be considered taking into consideration the judgment of this Court in Sri Kaustuva Sahu v. State of Odisha and others, 2017 (II) OLR 342 within a stipulated time, to

which learned State Counsel has raised no objection.

As agreed to by learned counsel for the parties and after going through the records, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the opposite party no.3, within fifteen days hence, the said authority shall consider the same and pass a reasoned and speaking order in accordance with law, taking into consideration the judgment of this Court in Sri Kaustuva Sahu (supra), as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with certified copy of this order.
