1. Heard Mr. L.N. Patel, learned counsel for the petitioner and

Mr. J. Katikia, learned Addl. Govt. Advocate for the State.

2. This application under section 482 of the Code of Criminal

Procedure has been filed by the petitioner, prayer has been made

for quashing the entire proceeding. Referring to Annexure-3 copy

of judgment in S.T. Case No. 183/75 of 2011 where the accused

has been acquitted, Mr. Patel, learned counsel prays for quashing

of the proceeding against the petitioner.

3. Mr. Patel, learned counsel for the petitioner files a memo Sukanta stating that true copy of the order dated 21.03.2023 has been filed,

but unfortunately the documents annexed to the memo is a typed

copy of the order dated 07.01.2023. Mr. Patel submits that the date

in the memo is a typographical error. SUKANTA Digitally signed by SUKANTA KUMAR KUMAR BEHERA 4. As the up-to-date order sheet was not produced by Mr. Date: 2023.05.09 BEHERA 20:33:38 +05'30'

Patel, learned counsel in spite of repeated adjournments a report

had been called for from the learned trial Court through the

Registry. The same has been received. Vide letter No. 477 dated

05.05.2023 received from the In-charge Additional Sessions

Judge, (LR & LTV), Sambalpur where it has been stated that

Ganga Sahu and Deepak Oram are facing trial and they have filed

the discharge petition which has been rejected on 22.03.2021 and

charge has been framed on 23.03.2021 and thereafter hearing of

the case his commenced. Till 05.05.2023, no prosecution

witnesses have been examined and the case is adjourned to

06.05.2023 for hearing.

5. Hearing is concluded.

6. Judgment is reserved.
