2. Mr. Panda, learned Counsel for the Appellants, so also Mr. P. Dash, learned Counsel on behalf of Mr. S.K. Dash, learned Counsel for the Intervener and Mr. Rout, learned Counsel for the State-Respondent are present.

3. Learned Counsel for the Appellants serves a copy of the Objection dated 17th October, 2022 to Misc. Case No.144 of 2016 for intervention on Mr. Dash, who prays for time to go through the same and have his say in the said regard.

4. Learned Counsel for the Appellants submits that Appellant No.1 has died during pendency of the Appeal and L.Rs. of Appellant No.1 are the present Appellant Nos. 2 to 5. To the said effect a Memo has been filed. However, no document to the said effect has been appended to the said Memo nor there is mention as to the date of death of Appellant No.1.

5. Mr. Panda orally prays to delete the name of Appellant No.1 from the Memorandum of Appeal. Prayer of Mr. Panda is allowed.

6. Consolidated Cause Title already filed vide Memo dated 17th October, 2022 be accepted and taken on record. Copy of the same be served on learned Counsel for the State, so also Mr. Dash, learned counsel for the Intervener.

7. Mr. Rout, learned Counsel for the State-Respondent submits that only a copy of Memorandum of Appeal has been served on him and he is yet to receive a copy of the impugned judgment.

8. Learned Counsel for the Appellants undertakes to serve a copy of the impugned judgment on Mr. Rout by tomorrow (29.03.2023).

9. Matter be listed in the week commencing from 3rd April, 2023 under the heading "For Orders" for consideration of application for intervention.
