        7.       1.      This matter is taken up through hybrid mode.

2. None appears for the Petitioner at the time of call.

3. Judgment dated 8th April, 2016 (Annexure-1) passed by learned Judge, Family Court, Khurda in Criminal Petition No.69 of 2015 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.3,000/- per month to the Opposite Party from the date of the application, i.e., from 22nd June, 2015.

4. There is a delay of eight days in filing the RPFAM.

5. Pursuant to the order dated 8th February, 2017, notice on the Opposite Party in the limitation matter has been made sufficient.

6. Since none appears on behalf of the Petitioner to pursue the matter, Misc. Case No.335 of 2016 filed for condonation of delay is dismissed. Consequently, the RPFAM stands dismissed being barred by limitation.
