3. 1. This matter is taken up through Hybrid mode.

2. None appears for the Petitioner at the time of call.

3. Ex-parte Judgment dated 6th January, 2014 passed by learned Judge, Family Court, Puri in CRP No.231 of 2011 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance at the rate of Rs.1,000/- per month to the Opposite Party from the date of the order.

4. Order sheet discloses that although the matter was filed on 18th May, 2016, but thereafter, no step has been taken by the Petitioner either to get the matter listed or to condone the delay of 774 days in filing the RPFAM. Moreover, none is present to move the matter event today.

5. In view of the above, the Misc. Case No.153 of 2016 filed for condonation of delay in filing the RPFAM is dismissed for non-prosecution. Consequentially, the RPFAM also stands dismissed being barred by limitation.
