                         3.               1.      This matter is taken up through hybrid mode.

2. The Petitioner in this writ petition seeks to assail the judgment and order dated 18th October, 2022 (Annexure-1) passed by learned Judge, Family Court, Nayagarh in I.A. No.17 of 2022 (arising out of C.P. No. 165 of 2019), whereby he has been directed to pay pendente lite maintenance of Rs.7,000/- per month to the Opposite Party till disposal of the civil proceeding. The Petitioner has also been directed to pay Rs.5,000/- to the Opposite Party towards litigation expenses.

3. In course of hearing, Mr. Rout, learned counsel for the Petitioner prays for withdrawal of the writ petition to move appropriate application before learned Judge, Family Court, Nayagarh.

4. In view of such submission, this Court without expressing any opinion on the merits of the case disposes of this writ petition as withdrawn.
