02. 1. This matter is taken up through hybrid mode.

2. On scrutiny it appears that some errors have crept into the order dated 03.01.2023. We did not issue any notice, but the appellant was asked to take steps.

3. In view of that, in exercise of the power as conferred by Section 114 of C.P.C., we score out the paragraphs no. 3 and 4 not being germane, from the order dated 03.01.2023.

1. Heard Mr. J.K. Khandayataray, learned counsel appearing for the applicant.

2. This is an application under Section 5 of the Limitation Act for condoning the delay of 14 days in preferring the appeal from the

Judgment dated 16.08.2022 delivered in Civil Proceeding No.172/294 of 2021 by the Judge, Family Court, Nayagarh.

3. Issue notice as to why the aforementioned delay shall not be condoned or any other order or orders shall not be passed as deemed fit and proper in the circumstances of the case.

4. Notice is made returnable on 10.03.2023.

5. It has been stated by Mr. Khandayataray, learned counsel that in view of the order dated 03.01.2023, steps have been taken.

6. Registry is directed to issue notice, if the steps are complete in all respects.

7. No further steps are required to be taken, if the steps as taken are sufficient.
