03. 1. This matter is taken up through Hybrid Mode.

2. Heard Mr. M.R. Padhi, learned counsel appearing on

instruction of Mr. S.K. Behera, learned counsel for the appellant.

3. This is an application under Section-5 of the Limitation Act

for condoning the delay of 191 days, as per the report of the Stamp

Reporter in filing the appeal from the judgment dated 10.02.2022

delivered in Civil Proceeding No.384 of 2016 by the Judge, Family

Court, Bhubaneswar.

4. Issue notice as to why the afore-mentioned delay shall not be

condoned or any other order or orders shall not be passed as deemed

fit in the circumstances of the case.

5. Notice is made returnable on 02.03.2023.

6. Steps for service of notice on the respondent be taken by the

appellant by Registered Post with A.D. by 21.01.2023.
