02. 1. This matter is taken up through Hybrid Mode.

2. Heard Mr. S.K. Pattanaik, learned counsel appearing for the

appellant.

3. This is an application under Section 5 of the Limitation Act

for condoning the delay of 29 days in preferring the appeal against the

judgment dated 05.07.2022 delivered in Mat Suit No.27 of 2016 by

the Judge, Family Court, Baripada at Mayurbhanj.

4. Issue notice as to why the aforesaid delay shall not be

condoned or any other order/orders shall not be passed in the

circumstances of the case.

5. Notice is made returnable on 17.02.2023.

6. Steps for service of notice on the respondent shall be taken by

the appellant within 13.01.2023 by Registered Post with A.D.
