2. Mr. S. Behera, learned counsel appearing for the petitioner contended that the case of the petitioner is covered by the order passed by this Court in Kishore Chandra Mishra v. State of Odisha (WPC (OA) No.2283 of 2017, disposed of on 01.12.2022).
3. Mr. S. Jena, learned Standing Counsel for School and Mass Education Department contended that the order cited by the learned counsel for the petitioner is not applicable to the petitioner in view of judgment of the apex Court in State of Uttar Pradesh v. Arvind Kumar Srivastava, (2015) 1 SCC 347.
4. Let the copies of the judgments be exchanged between the two counsels and examine whether the judgment is applicable to the petitioner or not.
5. Put up this matter after two weeks connecting with W.P.(C) No.2900 of 2018.
