06. This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Mr. Devashis Panda, learned counsel appearing for the petitioner submitted that in similar facts and circumstances, another case was instituted against the petitioner which was registered as V.G.R. Case No.37 of 2010 corresponding to T.R. Case No.35 of 2017 in the learned Special Judge, Vigilance, Cuttack in which cognizance of the offences was taken under sections 468/420/120-B of the Indian Penal Code and process was issued against the petitioner and the petitioner challenged the order of taking cognizance and issuance of process before this Court in CRLREV No.273 of 2019 // 2 //

and this Court vide judgment and order dated 25.11.2022 has been pleased to quash the order of issuance of process. He further submitted that another co-accused, namely, Debendra Kumar Panda also challenged the order of taking cognizance and issuance of process which was also allowed. The copies of the judgments passed in CRLREV No.273 of 2019 and CRLREV No.596 of 2018 are filed and taken on record.

Let copies of the judgments be served on Mr. Sangram Das, learned Standing Counsel for the Vigilance Department during course of this week for verification and necessary instruction.

It is stated at the Bar that in the trial Court, the date is posted to 01.03.2023 for framing of the charge.

List this matter on 14.03.2023.

In case an adjournment application is filed by the petitioner before the learned trial Court, appropriate order shall be passed in that respect.

Urgent certified copy of this order be granted on proper application in course of the day.
