   24.      1.      This matter is taken up through hybrid mode.

2. Judgment dated 28th November, 2007 passed by learned Civil Judge (Senior Division), Berhampur in T.S. No.98 of 1998 is under challenge in this appeal, whereby the Appellant has been directed to pay maintenance @ Rs.1,500/- per month to each of the Respondents from the date of institution of the suit, i.e., from 31st July, 1998.

3. Mr. Nayak, learned counsel for the Appellant submits that no interim order has been passed in this appeal. He further submits that both the Appellant and Respondent No.1 have already become senior citizen and the Appellant has already retired from service. Respondent No.2 has also attained the age of majority. Hence, no fruitful purpose will be served in pursuing the appeal at such a belated stage. He, therefore, submits that the matter be disposed of accordingly.

4. Mr. Pradhan, learned counsel for the Respondents does not have any objection to the same.

5. In view of the above, this appeal is disposed of without interfering with the impugned judgment.
