        4.       1.        This matter is taken up through hybrid mode.

2. Judgment dated 6th September, 2011 passed by learned Judge, Family Court, Berhampur in Cr.P. No.757 of 2010 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance @ Rs.2,000/- per month to Opposite Party from the date of the order.

3. Mr. Mishra, learned counsel being authorized by Mr. Pujari, learned counsel for the Petitioner submits that they have no instruction in the matter.

4. It also appears that defects, pointed out by the S.R. have not been removed. Steps for limitation have not been taken in the matter.

5. In that view of the matter, the RPFAM stands dismissed for non-prosecution.
