3. 1. This matter is taken up through hybrid mode.
2. Petitioner in this RPFAM seeks to assail the judgment dated 26th October, 2019 (Annexure-3) passed by learned Judge, Family Court, Baripada in CMA No.3 of 2017 (arising out of CMC No.117 of 2015), whereby an application filed by the Petitioner under Section 126(2) Cr.P.C. to set aside the ex-parte order dated 23rd May, 2017 in CMC No.117 of 2015 has been dismissed.
3. Mr. S.S. Bhuyan, learned counsel being authorized by Mr. Bibekananda Bhuyan, learned counsel for the Petitioner by filing a memo submits that the matter has already been amicably settled between the parties. Hence he prays for withdrawal of the RPFAM.
4. In view of the memo filed and submission made, the RPFAM is dismissed as withdrawn.
