    1.    1.     This   matter   is   taken   up   through    Hybrid

Arrangement (Virtual/Physical) Mode.

2. At the outset, learned counsel for the Petitioner prays for deletion of Opp. party Nos.1 & 2 from the cause title in Court today. The prayer is allowed.

3. This Contempt Petition has been filed challenging the non-compliance of the order dated 14.02.2023 passed in W.P.(C) No.3010 of 2023 and batch.

4. It is contended that though there is no time stipulation for compliance of the order, but in view of the judgment of this Court so passed in the case of Sri Binayak Swain & Others vs. Bijaya Kumar Pattanik & Others, it has been held that when there is no time stipulation for compliance of the order then period of 90 days be taken as the period for compliance of the same.

5. Since in the present case period of 90 days has already elapsed and the order has not yet been complied with, while disposing the Contempt Petition this Court directs Opposite Party No.3 to comply the order within a period of one (1) month from the date of receipt of this order, failing which adverse view will be taken.

6. Accordingly, the Contempt Petition stands disposed of.
